Small Business Community Urges Kansas House to Curb Lawsuit Abuse

“The Senate has acted, and now it’s time for the House to stand up for small business owners.”

TOPEKA (March 2, 2026) – The National Federation of Independent Business (NFIB), Kansas’ leading small business advocacy organization, is calling on the House of Representatives to quickly consider and advance SB 413, a reform that would curb lawsuit abuse.

In a statement, NFIB State Director Dan Murray warned that frivolous litigation increases costs on small business owners and their consumers.

“When attorneys suggest exorbitant damage amounts during trials, it can lead juries to award runaway verdicts. These flashy figures have a way of distorting reality and making frivolous lawsuits all the more likely. When Main Street business owners are hit with a lawsuit, they have to divert time and resources away from running their business. SB 413 is a commonsense guardrail to promote trust and fairness in our judicial system. The Senate has acted, and now, it’s time for the House to stand up for small business owners.”

Background:

Senate Bill 413 prohibits attorneys and parties in civil actions from suggesting specific amounts to juries for awards of non-economic damages, a practice known as “jury anchoring.” The Senate sent this bill to the House on 29 – 11 vote.
