NFIB Issues Action Alert on Senate Bill 310

NFIB Issues Action Alert on Senate Bill 310

May 28, 2025

Measure side-steps PAGA reforms, would greenlight higher settlements

NFIB is rallying its members to reach out to their State Senators to let them know of their opposition to Senate Bill 310.

SB 310 (Wiener) undermines the recent Private Attorneys General Act (PAGA) reforms NFIB labored long and hard to achieve by gifting trial attorneys a new means of leveraging wage-and-hour cases against employers of every size for high settlements.

More about those reforms at the web story, NFIB Webinar Talks PAGA Reform and Small Business.

SB 310 would permit workers to sidestep the issues when filing a wage claim with the Labor Commissioner’s Office (LCO) or PAGA by allowing them to file private civil lawsuits for Labor Code section 210 violations while still recovering 100% of the penalties they would have received at the LCO, effectively giving workers a new third option.

This bill is extremely problematic because it introduces a new pathway for trial attorneys to exploit penalties as leverage in meritless wage-and-hour cases.

Look for your Action Alert that makes it push-button easy to make your voice heard by contacting your Senator TODAY and ask them to oppose SB 310 and support small business.

If you have not received it or may have misplaced it, please send an email to NFIB Grassroots Manager Elizabeth Bassett, elizabeth.bassett@nfib.org.

SB 310 is on third reading in the Senate, just one more vote away from passing over to the Assembly before the June 6 deadline.

Please act now.
