NFIB Applauds LA Senate for Voting ‘Yes’ on Critical Insurance Reforms

The legislation would help fight lawsuit abuse and lower costs for small businesses

NFIB State Director Leah Long today applauded the Louisiana Senate for passing key insurance reform bills to fight lawsuit abuse and help lower costs for small businesses.

“Small business owners are fed up with frivolous lawsuits and sky-high insurance premiums,” Long said. “Too often, the legal system rewards trial lawyers instead of focusing on fairness. These reforms would help level the playing field.”

The Senate today passed:

HB 431 by Rep. Emily Chenevert would limit damage recovery if the plaintiff is found to be 51 percent or more at fault, bringing Louisiana in line with 38 other states that use a version of modified comparative fault.
House Bill 434 by Rep. Jason DeWitt would apply a “no pay, no play” provision with a $100,000 cap.
HB 450 by Rep. Michael Melerine would end the Housley Presumption, a rule that assumes injuries were caused by an accident without proof. The bill would require the injured party to show that the accident actually caused the injuries.
SB 231 by Sen. Mike Reese would change how much someone can recover in a lawsuit for past medical bills.

“These changes are a big step toward fixing a system that hasn’t been fair to small businesses,” Long said. “Insurance costs are out of control, and lawsuits have made it worse. These bills are about restoring fairness, encouraging growth, and helping local businesses thrive.”
