NFIB Illinois Provides Public Comments on new Temporary Labor and Staffing Agency Regulations

September 28, Chris Davis, NFIB State Director in Illinois testified at a Public Hearing regarding Department of Labor’s published Emergency Rules implementing changes to the Day and Temporary Labor Services Act.  The enacted legislation imposes significant burdens on Staffing Agency small businesses and provides temporary workers with expanded rights and benefits. A portion of Davis’ letter commends the state for filing emergency rule after the legislation became law. Davis writes that the Department was “trying to provide both staffing agencies and private employers with guidance onenforcement and compliance. The Act, itself, is extremely confusing and lacking in clarity and will be extraordinarily difficult to implement. Therefore, the employer community is thankful for the Department’s efforts in attempting to provide direction. However, these published Rules fall short of providing clarity and complicate difficulties faced by employers by the Act, as they are in some cases, inconsistent with the Act and implement policies outside the scope of the enacted legislation” You can read the rest of NFIB’s comments can be found here.
