New Illinois Job-Posting Requirements Effective January 1

Beginning January 1, 2025, Illinois employers with 15 or more employees must include a pay scale and description of employee benefits in specific-job postings.

Covered employers must also inform their employees of promotional opportunities within 14 days of making an external job posting for a position.

Violations could result in civil penalties:

  • A first offense could result in a fine of up to $500 for an active posting (up to $250 for an inactive job posting)
  • A second offense could result in a fine of up to $2,500
  • A third or subsequent offense could result in a fine of up to $10,000

The statute provides for a 14-day curing period for a first offense and a seven-day curing period for a second offense. No curing period is permitted for third or subsequent violation.

More information about the new requirements can be found on the Illinois Department of Labor’s website, including frequently asked questions.

The new requirements were included in Public Act 103-0539, which was signed into law by Governor Pritzker on August 11, 2023.
