Jury duty is a civic obligation with no "hardship exemption," so small business owners need to have a written policy addressing time off for employees who are called to serve.
"Nearly all states prohibit an employer from taking any disciplinary action against employees for taking time off to serve on a jury," said Beth Milito, Sr. Counsel for the NFIB Small Business Legal Center. "Some states even require the time off to be granted on a paid basis." Milito suggests the policy address such issues as: 1) Requiring employees to provide a copy of the summons to a supervisor; 2) Stating whether time taken is on a paid or unpaid basis; 3) Determining if employees are expected to return to work if dismissed early during the workday. 2:28
