The owner of a Bartlett lawn care company discusses his role in a recent NFIB lawsuit against the FTC

NFIB member Kenny Crenshaw, owner of a lawn care company in Bartlett, appears on the latest episode of NFIB’s Small Business Rundown podcast to discuss how recent U.S. Supreme Court cases impact small businesses.

Crenshaw, owner of Herbi-Systems Inc., an NFIB member business in Bartlett, played an important role in NFIB’s recent legal victory against the Federal Trade Commission’s overreaching “Click-to-Cancel” Negative Option Rule.

Crenshaw was among the small business owners who submitted a declaration in the case of Custom Communications, Inc. v. Federal Trade Commission. “My part of it was simply to tell my story about how this new rule was going to severely impact my business and our customers,” he said.

Crenshaw said the rule would have created unnecessary costs and inconveniences for both his business and customers.

He also emphasized why NFIB’s advocacy matters: “If it weren’t for NFIB, the small businessperson would just get run over. We don’t have the resources, we don’t have the money, and most of us are blindsided when these things happen.”
