Round-up of Key 2020 Victory Bills
Healthcare and Business Liability Protection. In the unprecedented wake of the pandemic, NFIB joined with others to fight for critical COVID-related business liability protections. Fortunately, we were successful! In the Special Session the Legislature passed HB2016, a that includes items related to emergency orders and the oversight of CARES Act funding. The bill provides some immunity from liability related to COVID-19 for healthcare providers and business.
- Business Liability. The bill states that a person conducting business in Kansas shall be immune from liability in a civil action for a COVID-19 claim if such person was acting pursuant to and in substantial compliance with public health directives. This section will expire on January 26, 2021 and is retroactive to March 12, 2020.
- Product Liability. The bill states that a person who designs, manufactures, labels, sells, distributes, provides, or donates a qualified product in response to the COVID-19 public health emergency shall be immune from liability in a civil action alleging a product liability claim involving the product and the damages are not occasioned by willful, wanton, or reckless disregard of a known, substantial, and unnecessary risk that the product would cause serious injury to others. The bill is retroactive to March 12, 2020.
