Michigan Small Business Protected from Frivolous Covid-19 Lawsuits

Date: October 20, 2020

Legislation will make it difficult for the trial lawyers to shake down small businesses.

When the Michigan Supreme Court declared Governor Whitmer’s Executive orders unconstitutional, NFIB seized on the opportunity to pass liability protections for small businesses that are trying to comply with Covid-19 regulations. The governor declared she would veto the NFIB supported liability protection bills when they got to her desk, but NFIB worked to tie the liability bills to other legislation she needed to sign to keep Unemployment Insurance benefits flowing to claimants. The governor relented and signed the liability protections into law. The passage of these protections against frivolous lawsuits stemming from the COVID-19 pandemic will make it difficult for the trial lawyers to shake down small businesses as they are trying to recover and restart.
