‘Judicial Hellhole’ Report Spotlights Need for Legal Reform in Texas

NFIB State Director Annie Spilman released the following statement today after the American Tort Reform Foundation put the Texas Court of Appeals for the Fifth District on its watchlist of “Judicial Hellholes.”

The foundation said the Dallas court “has developed a reputation for liability-expanding decisions. The court disregarded the state’s longstanding prohibition on introducing evidence about different products and dissimilar accidents and held a defendant liable for injuries caused by a product that exceeded safety standards.”

Spilman said, “Every jurisdiction deserves courts that treat everyone fairly and where judges don’t try to legislate from the bench. When the legislature returns to Austin, we will continue to work on behalf of our members for reforms that discourage frivolous claims and ensure that the scales of justice remain balanced.”
