Did Your Biz Overpay for Workers' Comp?

On December 14, Pennsylvania’s Insurance Commissioner, Jessica Altman announced that she had approved a change to fix a data error that caused businesses to be overcharged for workers’ compensation insurance premiums since April 1, 2018. NFIB stood firm in our belief that insurers who did inadvertently overcharge small businesses in 2018 should pay back that money. 

Commissioner Altman, in her message approving the January 1, 2019 correction acknowledged that “…it is possible that some businesses paid higher rates than they should have.” She urged all workers’ compensation insurers to “…determine as quickly as possible whether this is the case for any businesses they insure, and to reimburse any businesses which have overpaid.”

NFIB members who renewed or began their workers’ compensation policies between April 1, 2018, and December 31, 2018, are urged to contact their insurer to determine whether they were affected by the error. The link below provides a list of the insurers that have submitted informational filings to provide a remedy for employers who were overcharged: https://www.insurance.pa.gov/Coverage/Business/Pages/Workers-Compensation-Informational-Filings.aspx.

NFIB also urges members to carefully check their renewal rates because they may not reflect the rates changes that occurred on January 1, 2019.
