What You Need to Know About New Overtime Regulations

With all the new changes in overtime regulations being thrown at small business at both the state and federal level, now is a crucial time to get the facts so your business stays out of trouble.

Labor law expert Dan Cohen, with Ogletree, Deakins, Nash, Smoak & Stewart, P.C. is hosting a live webinar later this month so you can learn and discuss how these new and proposed changes will impact your small business.

Under current federal law, salaried employees who make less than $23,660 a year, or $455 per week, are exempt from the requirement to pay overtime if they work more than 40 hours a week. The Obama administration tried to increase the salary threshold to $47,476 several years ago, however, was ultimately unsuccessful after NFIB stepped in with a lawsuit. Under the Trump administration, the salary threshold will increase from $23,660 to $35,568 a year, or $684 a week on January 1 of 2020.

However, to make matters more complicated for Michigan small business, Governor Whitmer recently announced plans to use the state’s Department of Labor and Economic Opportunity (via the rules process) to go around the legislature, and Michigan and federal law. The governor wants to expand overtime pay eligibility by increasing the minimum salary for the overtime exemption to as much as $61,000.

Mr. Cohen has counseled management and represented employers in all aspects of labor law, employment law and litigation exclusively since 1988. Before joining Ogletree Deakins, he had been a founding principal of a respected local boutique for more than 16 years.

A large part of his practice involves the assistance of human resource professionals with the administration of workplace policies and procedures with an emphasis on litigation avoidance, wage and hour compliance, workplace violence prevention, affirmative action, union negotiations and contract administration, arbitration and union elections.
