FL Legislature on 'Judicial Hellhole' Watchlist

Date: December 07, 2021

NFIB State Executive Director Bill Herrle released the following statement today after the American Tort Reform Foundation put the Florida Legislature on its “Judicial Hellholes” watchlist. In its report, the foundation said, “Despite all the work done by the Florida Supreme Court and Governor Ron DeSantis to mitigate lawsuit abuse, much-needed reforms continue to stall in the Florida Legislature…. Issues that need to be addressed include inflated medical damages, bad faith reform, litigation financing, and attorneys’ fees multipliers.”

Herrle said, “Our members continue to work with their local legislators to stop predatory practices such as third-party litigation financing and jury awards that are based on inflated and even fictional medical costs. The cost of defending itself against even one frivolous claim can destroy a small business, even if the case is ultimately thrown out of court.

“When the legislature returns to Tallahassee in January, we will continue to press for commonsense legal reforms that treat both sides fairly.”
