New sexual harassment regulations finalized for New York employers

Earlier this week the NYS Department of Labor, Division of Human Rights released formal guidance for new regulations regarding workplace sexual harassment that all employers, including small businesses, must comply with. The documents include guidance for a model sexual harassment policy, interactive sexual harassment training, and a model sexual harassment complaint form.

All model guidance provided by the Department of Labor can be found on New York State’s Combatting Sexual Harassment in the Workplace web portal.

Specific guidance and examples for employer sexual harassment policies, sexual harassment complaint forms and sexual harassment training can be found here.

NFIB’s New York State office submitted extensive comment to the Department of Labor during the public comment period and it appears some of our concerns have been addressed.

We had asked that the implementation date for adoption of a workplace sexual harassment policy be delayed allowing for small businesses to better understand and comply with what’s required of them, unfortunately that request was not granted.

NFIB strongly encourages all its members to adopt a workplace sexual harassment policy by October 9thBusinesses can use the model policy provided by the New York State Department of Labor but have the right to devise their own policy as long as it exceeds the standards set by the State’s model policy.

NFIB is continuing to review the recently released information and will be communicating additional information with our members as necessary.
