NFIB Reacts to Assembly Passing Important Prop. 65 Reform
Small businesses urge Governor Brown to Sign AB 1583 (Chau)

SACRAMENTO, Calif., September 15, 2017 – Following the California State Assembly passing Assembly Bill 1583 (Chau) last night, NFIB California State Executive Director Tom Scott issued the following statement on behalf of our 22,000 small business members:

“We are pleased with the passage of AB 1583 and are urging Governor Jerry Brown to sign this bill as it would promote fairness and transparency in lawsuits brought under The Safe Drinking Water and Toxic Enforcement Act of 1986, also known as Proposition 65.

“Unfortunately, laws such as Prop. 65 which were originally crafted to protect everyday Californians have instead become lucrative payday opportunities for trial lawyers looking to make an easy buck on the backs of small businesses who have caused zero harm to their employees or customers. AB 1583 would help curb this economic incentive by requiring the California Attorney General to review a certificate of merit and deem whether there is or is not merit to the legal action. This would help relieve the growing threat of costly litigation for struggling small businesses across this state.

“Because this bill would bring pragmatic reform to Proposition 65, NFIB is strongly urging Governor Brown to sign AB 1583.”
