Bakersfield-area NFIB Members Briefed on Dynamex/Assembly Bill 5

Who is an employee? Who is an independent contractor?

The continuing education of its members on issues vital to their survival is one of the most praised benefits of belonging to NFIB. Combine it with the events NFIB holds that put its members in direct contact with elected officials and you have two reasons why NFIB is universally recognized as the true voice of small business.

One such member event with elected officials was held in Bakersfield, October 4, where Sen. Shannon Grove and Assemblymember Vince Fong joined with NFIB California officials for a discussion on what Assembly Bill 5 has wrought in its attempt to codify the California Supreme Court’s Dynamex decision.

The court sought to clarify simply and once-and-for-all who are employees and who are independent contractors. Instead, the decision created more questions and confusion that were only compounded with Assembly Bill 5’s stab at trying to put the decision into state code.

Instead of adhering as closely as possible to Dynamex, AB 5 became a giant carve-out for some occupations but not others. Furthermore, more occupations will seek exemptions from Dynamex when the Legislature returns in January.

Helping Grove and Fong to make sense of it all were NFIB staff attorney Luke Wake; NFIB California State Director John Kabateck; NFIB Leadership Council Chairman Darrell Feil; Nick Ortiz, president of the Greater Bakersfield Chamber of Commerce; and Kaelyn Peterson, policy and public affairs manager of the Bakersfield Chamber.
