Beason v. I.E. Miller Services – Legal Reform

This case concerns the constitutionality of Oklahoma’s noneconomic damages caps. This court challenge follows up on an earlier Oklahoma Supreme Court opinion invalidating a comprehensive tort reform law because that comprehensive law addressed too many subjects (the Court claimed that the comprehensive legislation constituted “logrolling,” prohibited by the Oklahoma Constitution).  The legislature then re-enacted the noneconomic damages cap at issue in this case. The appeal arises out of a judge’s reduction of a $5 million jury award for noneconomic damages to the statutory cap of $700,000 (with a cap of $350,000 each for both claimants, a husband who was injured by a toppled crane, and his wife).

Oklahoma Supreme Court VICTORY!

NFIB filed an amicus brief in a lawsuit challenging a new state law that fixed Oklahoma’s broken workers’ compensation system. The court is being asked to uphold a 2013 reform law, which replaced Oklahoma’s adversarial court-based system with an administrative system that’s easier for both sides to navigate.
