Lewis v. Alabama – Labor and Employment

The Legal Center joined with other Alabama business groups to defend the state’s uniform minimum wage law. The brief argued that a patchwork of different wage rates throughout the state would hinder economic development by raising labor and compliance costs for businesses.

 

Murphy Oil v. NLRB – Labor and Employment

The NFIB Legal Center argued in an amicus brief that arbitration agreements are both protective of employee rights and helpful for employers looking for expeditious and less costly alternatives for resolving legal disputes and that it is perfectly lawful, under the Federal Arbitration Act, to incorporate arbitration agreements into employment contracts, as a means of ensuring quick and cost-effective resolution when legal issues may arise.

 

Farmers Insurance v. Morris – Legal Reform

Alabama Supreme Court – petition for rehearing

In this case, which involves the firing of an agent, the Alabama Supreme Court allowed oral statements to take precedence over written disclosures, and overrode the long-standing “at will” employment doctrine since it alleged that the employee was “fraudulently induced” to leave his former job to join Farmers, and also dismissed the “merger” clause in the agent’s employment agreement that expressly said that all promises and negotiations were superseded by the written provisions of his agent agreement. NFIB legal center joined an amicus brief urging the court to rehear and reconsider the decision, which will forestall trial courts from granting summary judgment or motions to dismiss.
