NFIB to renew fight for workers' compensation reform
The 94th South Dakota Legislature opens for business Jan. 8, 2019, with an immediate challenge for small business.
Workers’ Compensation Reform
In 2018, the Legislature considered, but did not adopt a proposal to reform the state’s workers’ compensation laws, reform that has been successful in other states. Senate Bill 145 sought a change of venue of a bad-faith claim against a workers’ compensation insurance carrier from a circuit court to the state Department of Labor, and it sought a cap the damages that may be awarded. NFIB supported passage of SB 145 because it would have likely lowered workers’ compensation premiums on small-business owners. NFIB will seek this reform again.
