NFIB Reacts to Assembly Penalizing Employers for Cooperating with ICE Agents
Small businesses urge Governor Brown to Veto AB 450 (Chiu)

SACRAMENTO, Calif., September 14, 2017 – Following the California State Assembly passing Assembly Bill 450 (Chiu) last night, NFIB California State Executive Director Tom Scott issued the following statement on behalf of our 22,000 small business members:

“We are deeply concerned with the passage of AB 450 and are urging Governor Jerry Brown to veto this bill as it places employers in a no-win situation between federal immigration enforcement officers and state labor enforcement officials by punishing employers for simply cooperating with federal immigration enforcement officers who appear at their workplace.

“AB 450 claims to be about protecting the rights of workers, but instead places employers in serious legal jeopardy, subjecting them to stiff fines and penalties of up to $10,000 for simply cooperating with federal law enforcement. Furthermore, this bill leaves serious ambiguities regarding a small business owner’s roles and expectations in an immigration enforcement incident. Would this bill make the small business owner the chief enforcement officer of ensuring ICE agents have a warrant before entering the premises? Could this bill put small business owners in the position of obstructing justice? How does this bill ensure a small business owner is not bring forced to defy federal law in order to enforce state mandates?

“Because this bill raises more questions than answers and makes our small business climate even more hostile in this state, NFIB is strongly urging Governor Brown to veto AB 450.”
