Legislative Halftime Marks Victories, Challenges Ahead for Small Business
Taxes, environmental regulations, and more lawsuits emerge as key threats for small business

SACRAMENTO, Calif., June 4, 2018 – Following the deadline for legislation to pass out of its respective house of origin Friday June 1, NFIB’s California State Director John Kabateck issued the following statement on behalf of our over 20,000 dues-paying small business members:

“Following a busy week with the California Legislature taking action on several hundreds of bills, small business owners are reflecting on this legislative halftime and taking stock of some victories, as well as a number of challenges ahead for the remainder of the legislative session.

“Although 10 of our 15 ‘Good’ bills, as identified in our Good, Bad, & Ugly bill list, failed to pass out of their respective house of origin, we are happy to report a handful of victories for small business from the first half of the legislative session thus far.

“We were able to block AB 2841 (Gonzalez Fletcher), which would have created a significant burden to all employers by expanding our 3-day paid sick leave mandate to 5 days. We also stopped AB 3087 (Kalra) which would have created a government-run panel to dictate healthcare prices, rather than working to reduce underlying costs. Finally, NFIB worked to help stop AB 1745 (Ting) which sought to ban new vehicles equipped with an internal combustion engine by the year 2040, which would have been extremely expensive for small businesses and working families.

“Unfortunately, a number of Bad and Ugly bills did successfully pass to the other legislative house, where NFIB will continue to oppose them. Among these challenges ahead include:

“AB 3080 (Gonzalez Fletcher) would significantly increase litigation by banning arbitration agreements as a condition of employment. SB 1300 (Jackson) would create a new private right of action to sue an employer for failure to prevent any perceived form of harassment, even when no harassment has occurred. Finally, SB 993 (Hertzberg) seeks to impose an unprecedented sales tax on services, which would be a severe burden on small businesses at a time when California has a multi-billion-dollar surplus.”
