Greetings NFIB member, recently you received a survey regarding NFIB taking a stand on U.S. Supreme Court (SCOTUS) nominees. This is a new approach for NFIB, but as SCOTUS has taken a central role in passing regulations that impact small business daily we feel that this nomination is important for our members. As a NFIB member you know that we operate as a one member, one vote organization and the membership of NFIB is responsible for shaping our policy. This is why it’s very important that you take the time to provide your opinion on this subject.
As you know, the death of Supreme Court Justice Antonin Scalia, a consistent vote in favor of property rights and against executive overreach, has left a vacancy on the nation’s highest court. President Obama has vowed to nominate a replacement in the coming days while the Senate Republicans want to wait and let the next president make that appointment. The court is currently made up of three seemingly “right of center” justices, four perceived “left of center” justices, and one moderate “swing” justice. The replacement for conservative Justice Scalia could potentially shift the balance of power at the SCOTUS. This is critical to understand since NFIB, and our Small Business Legal Center, is actively fighting in the courts challenging many anti-business regulations. For that matter, Scalia’s replacement may be of immediate consequence to currently pending NFIB lawsuits challenging illegal regulations from the Environmental Protection Agency, National Labor Relations Board and other federal agencies. Scalia was a key vote in striking down certain portions of Obamacare in NFIB v. Sebilius.
