NFIB Works to Recoup Workers' Comp Overcharges

It was revealed that a data error may have led to increased premiums

Recently, it was revealed that many small business owners in Pennsylvania may be overpaying for their workers’ comps premiums. The problem was caused by a data error in the compilation of “loss costs” of insurers, which has an impact on premiums. NFIB is calling for insurance carriers to return businesses the funds.

The Pennsylvania Compensation Rating Bureau, an independent nonprofit that helps set premiums for workers’ comp insurance, is correcting the error through a filing with the state’s Insurance Department, effective on January 1. But, because that change is not retroactive to April 1, when the overcharges began, NFIB is pursuing reimbursement options, but a solution has not yet been reached.  

“I think that it’s going to be a very thorny issue,” said Luke Wake, Senior Staff Attorney for the NFIB Small Business Legal Center, of discussions on how to resolve the problem. “Meanwhile the small-business owners really just care about getting paid back what they were overcharged.”
