Terminating employees is a scary proposition for small business owners. Even when an employee displays misconduct warranting a termination, small employers are concerned that they handle it correctly to avoid a lawsuit. Perhaps that’s why termination questions are the second most popular issue facing callers of NFIB’s free Employment Law Hotline.
To help take the fear out of terminating employees, the NFIB Small Business Legal Center, the legal resource for small business owners nationwide, presented the educational webinar: Properly Terminating Employees to Avoid a Lawsuit.
This webinar helped guide employers through the proper procedures of terminations so that they could limit the possibility of facing a wrongful termination lawsuit.
The webinar covered:
• Proper documentation — Keeping records of poor performance or misbehavior is essential to the termination process. We showed employers when they should give employees written warnings and other notices so that the final termination is not a surprise.
• Avoiding retaliation claims — Many wrongful termination suits allege that the employer is retaliating against the employee for lawful conduct. We demonstrated how to watch out for circumstances where terminating an employee could lead to a retaliation suit.
• Answers to other termination questions.
