LHT Capital, LLC v. Indiana Horse Racing Comm'n – Administrative Remedy

Indiana Supreme Court

The case concerns whether and when the Indiana courts have jurisdiction to determine the validity of an agency rule. The trial court and the Court of Appeals of Indiana both dismissed LHT's action on the grounds that the court lacked jurisdiction, as LHT had failed to exhaust administrative remedies.

Status: DECIDED. Amicus brief filed in October 2008. Court denied review.
