Bugosh v. I.U. North America, Inc.--Asbestos Reform

Pennsylvania Supreme Court

The Pennsylvania court has granted review of an asbestos case that presents the issue whether to apply the old Restatement (Second) of Torts (which the trial court applied) or the newer Restatement, Third of Torts: Products Liability, which would allow defendants to introduce state-of-the art evidence as to what the defendant knew or should have known about the dangers of the product in question at the time of the sale/exposure.

 

Status: PENDING. Amicus brief filed in support of defendants on June 16, 2008.
