Joyce Livestock Co. v. United States – Supporting NFIB Member's Petition for EAJA Fees

U.S. Supreme Court

This petition for cert, filed on behalf of two family-owned ranching businesses in Idaho, Joyce Livestock Company (an NFIB member) and LU Ranching Company, asks the Supreme Court to decide whether a state court with jurisdiction over the United States may award attorneys' fees against the United States under the federal Equal Access to Justice Act. EAJA is intended to help small businesses recover attorneys' fees when they prevail in a suit against the government and is intended to prevent government harassment.

Status: PENDING. Amicus brief filed in support of NFIB member Joyce Livestock’s petition for cert review Sept. 28, 2007.
