NFIB Statement on Government Decision to Forego 11th Circuit Appeal in Health-Care Lawsuit


WASHINGTON, D.C., September 26, 2011 —NFIB’s Legal Center released the following statement after the Department of Justice indicated that it would not be asking the full 11th Circuit to rehear the constitutional challenge of the individual mandate; the case now heads to the Supreme Court. 

"NFIB is excited that all indications point to the government going directly to the Supreme Court to hear our case and commends the Administration on their decision,” said Karen Harned, Executive Director of NFIB’s Small Business Legal Center. “The uncertainty created by the healthcare law on small businesses and other job creators is an immeasurable and burdensome effect on the economy. We are hopeful that the Supreme Court will take our case immediately."
