Fixed Commercial Fax Regulations
A new law passed by Congress and signed by President Bush allows businesses to continue sending commercial faxes to their customers when they have an "established a business relationship." Before this law was passed, the Federal Communications Commission had issued "do-not-fax" regulations that would have required signed, written permission from recipients before a business could send commercial faxes. Under this regulation, businesses would not have been able to fax based on the common-sense understanding that the recipient is a customer. Businesses could have faced stiff fines and potential judgments ranging from $500 to $11,000 per unsolicited fax. This new law will prevent small businesses from having to spend time and money to comply with this burdensome regulation. NFIB monitored the regulatory process to ensure that regulators follow congressional intent. The new regulations go into effect Aug. 1, 2006.
