and New Medical Motion Procedures
On
April 1, 2008, all Employer/Carrier/Administrators received the
following notice in the Form 18 Acknowledgment letter:
“ATTENTION EMPLOYER/CARRIER/ADMINISTRATOR: Within 30 days after
receipt of the Form 18, you must file a Form 21, 60, 61, or 63 to
admit, deny or pay without prejudice. The failure to comply with
this requirement will subject you to sanctions.”
However, during the implementation period of April 1, 2008
through July 31, 2008, no sanctions will be imposed.
Emergency Medical Motions:
In
compliance with
N.C. Gen. Stat. §97-78(f), the Commission has memorialized
its procedures for processing medical motions regarding an
emergency situation through these
Minutes.
Please click on the link for each department that handles such
motions to see the procedures. Motions are submitted to either
(1) the
Executive Secretary’s Office, (2) the
Chief Deputy Commissioner’s Office, or (3) the
Chair of the Industrial Commission’s Office.
Expedited Medical Motions:
Pursuant to the mandate set forth in
N.C. Gen. Stat. §§97-78(f)(2) and
97-78(g)(2), and
after extensive deliberations by a task force comprised of N.C. Industrial Commission staff and plaintiff and defense
counsel, the N.C. Industrial Commission hereby adopts
the following new Expedited Medical Motion procedure, which will
be implemented, effective August 1, 2008, through these
Minutes. Please clearly indicate on the
Form 33 or the
letter of appeal that the only issue to be considered is
medical. Also, if you are appealing an Administrative Order from
the Executive Secretary’s Office, please attach a copy of the
Order with the Notice of Appeal. Effective August 1, 2008,
please send correspondence concerning Expedited Medical Motions
to the following e-mail address:
medicalmotions@ic.nc.gov. The following link sets
forth the procedures under which Expedited Medical Motions may
be submitted:

In
compliance with N.C. Gen. Stat. §97-78, the Industrial
Commission hereby adopts, effective August 1, 2008, new and/or
