The law imposes a two-year moratorium on the harvesting of horseshoe crabs. The National Federation of Independent Business Legal Foundation is supporting a Delaware fisherman trying to protect his business who went to court to challenge this regulation under the Delaware Regulatory Flexibility Act. The DRFA requires state agencies to consider how burdensome any regulation will potentially be to small businesses. The NFIB Legal Foundation, a national leader in ensuring that federal and state governments comply with RFA laws, filed a motion with the court to participate in this case as a friend of the court. Today, the judge found that NFIB's expertise would be beneficial, since this is the first DRFA case to be heard in Delaware.

Wed, 28 Mar 2007 00:00:00 PST

New London: The Landscape One Year Later

The 2005 U.S. Supreme Court ruling in Kelo v. the City of New London, Conn., gave local governments the right to condemn and seize private property for outside private development, endangering the rights--and livelihood--of small-businesses and homeowners alike. This unfair ruling made it possible for small businesses to be forced to move when a local government decides another business—often a large-scale development project—could make more money in that same location.

Thu, 10 Aug 2006 00:00:00 PST
