Palmetto State Update -- Sept. 30, 2008
09/30/2008

New rules for credit cards
President Bush has signed a bill affecting most small business owners who accept credit cards. It requires payment card processors to report the net dollar amount of card receipts to the IRS.

Small business owners must provide their Taxpayer Identification Numbers to the processors they accept. If the TIN is not provided, the processor will withhold 28 percent from the gross transactions of that business.

The law will apply to tax returns for calendar years beginning Jan. 1, 2011. The back-up withholding provisions do not apply until Dec. 31, 2011. The law does not apply to small businesses that accept less than $10,000 in credit card transactions in a calendar year or those that make less than 200 payment card transactions a year.

Small business owners should have a good system for backing up records of credit and debit card transactions. Be sure to keep separate files for each credit card issuer, and save credit card records for seven years in case you're audited.
