The court will decide whether a corporate owner is personally liable for double damages for unpaid wages in a situation where wages were not paid because the company was in Chapter 11 and/or Chapter 7 bankruptcy and the bankruptcy trustee refused to authorize wage payments. NFIB's brief argues for an exception to Washington's wage and hour statute, under which employers who couldn't pay their employees because of bankruptcy proceedings would not be liable for double damages.
