Impact of Administrative Rules on Small Business
Issue Overview: HB 53 sponsored by Rep. Stephen D. Clark further clarifies the intent of legislation passed last year to relieve small business of a high economic impact from state agency rule making.
HB 53 would require a state agency to consider methods to minimize the impact of an agency's proposed administrative rule on small business.
It would require a state agency as part of a five-year review of its administrative rules, to explain in writing how the economic impact of a rule on small businesses may be minimized by the agency's intent to continue, amend or repeal the rule.
The bill also changes the time allowed for a party to challenge an agency rule by judicial review and makes some technical corrections regarding cross references.
NFIB Position: NFIB/Utah supports Rep. Clark in the passage of HB 53 during the 2008 legislative session.
