Loser-Pay Legislation in Kansas

Issue Overview: Legislation should be adopted to require the "loser" to pay all attorney fees and court costs in all non-personal injury lawsuits.

NFIB Position: NFIB supports this proposal. This question was asked on a NFIB/Kansas State Member Ballot and 89.6 percent of the respondent voted YES in support of this measure.

What to Say: Most countries in the civilized world have this provision in their civil law. A number of states already have enacted such provisions. It is an important means of reducing frivolous lawsuits and burdensome legal expenses for small-business owners.
