Missouri Alliance for Retired Americans v. Dept. of Labor – Defending Workers' Comp Reforms

Missouri Supreme Court

In this case, the Missouri Supreme Court will determine whether or not the amendments to the state's workers' compensation system approved by the state legislature in 2005 are constitutional. These amendments to the Missouri Workers' Compensation Act, passed as Senate Bill 1, were enacted in response to the widespread abuse of the past workers' compensation system. The changes to the system were drastically needed. Before 2005, the system covered nearly any type of injury that occurred to any worker that had even the most remote relation to work. The Legal Foundation filed an amicus brief urging the state supreme court to uphold the constitutionality of Senate Bill 1.

Status: PENDING. Amicus brief filed Aug. 22, 2007.
