In response to a 2004 Supreme Court decision, the Equal Employment Opportunity Commission recently revised its Age Discrimination in Employment Act regulations to reflect that favoring older workers over younger ones, even when all employees are older than 40 years of age, is not prohibited by the ADEA.
The EEOC also noted that it is interpreting federal law, and that state and local governments may continue to determine whether instances of age preference are in violation of state or local laws.
NFIB was one of only nine organizations to submit a public comment to the EEOC, and applauds the decision to amend the ADEA.
