The debate and public policy issues around eminent domain reform can be complex with many views expressed from small business, property owners and government agencies.
We support the following reforms:
- First and foremost, we support a prohibition on the taking of a small business for the purpose of economic development.
- Compensation for any and all expenses associated with the taking of a small business including costs of relocating, lost business, and expert and legal fees. This is an issue of fairness and currently a source of abuse. In fact, this is likely the simplest reform before you to understand, and may have the greatest impact and provide the best protection for property owners and small businesses.
- The recognition of "goodwill" and compensation for the loss of "goodwill" if a small business is taken or displaced.
Please remember, there is nothing more valuable to an individual than their home or small business. They are entitled to compensation and fair representation -- at a minimum the same level of representation as their government and/or condemning authority and to be compensated for their loss.
