California Supreme Court
In a precedent setting case, Fisher Scientific Company has asked the California Supreme Court to review a trial judge's decision that denied a motion to dismiss a nonresident's asbestos claim in California. California has seen a large influx of asbestos, in essence making it a dumping ground for cases that can and should be heard elsewhere. California's growing business of "litigation tourism," unlike other forms of tourism, does not benefit the state. To the contrary, the demands of resolving claims that belong in other states impose unfair burdens on California's courts and citizens.
Status: PENDING. Amicus brief filed in support of Fisher Scientific Aug. 16, 2006.
