Eminent Domain 

After facing several hurdles a bill that places limitations on the use of eminent domain is moving through the State Senate. House Bill 4048 stipulates that eminent domain may not be used to condemn property for private retail, office, commercial, industrial or residential development, or for enhancement of tax revenue.

House Bill 4048 has passed out of the House of Delegates where it originated in Judiciary Committee. The bill has since passed out of Senate Economic Development and Government Organization Committees. It must now pass out of Senate Judiciary Committee prior to being voted upon by the full Senate.

Issue Status: House Bill 4048 has passed out of the State Senate.

NFIB Position: NFIB followed H.B. 4048 throughout the legislative process being mindful of its impact on the business community. We consider the passage of this bill a major triumph for all of West Virginia.
