Olivo v. ExxonMobil Corporation - Fighting Employer Liability for Third Parties

The NFIB Legal Foundation filed an amicus brief on behalf of ExxonMobil to prevent expansion of employer liability to third party, nonemployees such as family members. The case is similar in principle and our victory in the New York State Court of Appeals in October.

Plaintiff, a former contractor who worked at various times for ExxonMobil, has filed a suit claiming that his wife developed an illness as a result of washing his asbestos-laden clothes. The appellate courts ruled in favor of the plaintiff. The NFIB Legal Foundation has joined ExxonMobil's appeal of this ruling in order to prevent a large increase in the cost of liability insurance premiums.

Status: DECIDED. Amicus brief filed in support of ExxonMobil Dec. 12, 2005. Court ruled in favor of the plaintiff April 24, 2006.
