Metropolitan Milwaukee Assoc. of Commerce v. Milwaukee County – Fighting Mandated Labor Agreements - Victory!

U.S. Court of Appeals for the Seventh Circuit

The NFIB Legal Foundation joined the Metropolitan Milwaukee Association of Commerce in challenging a Milwaukee County ordinance that requires certain employers (those who provide county-funded care to elderly or disabled persons) to sign labor agreements with unions seeking to organize their employees. Covered contractors must provide the union with employees' names, addresses and telephone numbers and to give the union reasonable access to the workplace for the purpose of providing union information. Disputes arising under the agreement must be arbitrated. The county has the right to terminate contracts with contractors who refuse to sign a labor agreement or are found by an arbitrator to have violated one.

Status: DECIDED. Amicus brief in support of MMAC filed April 18, 2005. Oral argument held Sept. 12, 2005. Court adopted NFIB's arguments and struck down the Milwaukee ordinance Dec. 5, 2005.
