Military Leave Information for Businesses

As reserve and National Guard members return to work in Montana following extended deployment, questions arise about the employers' obligations to these returning soldiers, sailors and airmen. In normal circumstances, employers are obligated to reinstate the returning service members. 

 

To be eligible for re-employment, employees must have provided notice to the employer of their need to take military leave, if possible. Upon their return from military leave, employees must return to work or apply for re-employment within a time period that is based on the time they spent on military deployment.

 

For period of less than 31 days, an employee must report to work on the next shift following release from the service, plus travel time and an eight-hour rest period.

 

For 31-180 days of deployment, an employee must reapply for employment within 14 days of service release, plus travel and rest period.

 

For 181 days to five years, an employee must reapply for employment within 90 days of military duty release.
