Santa Clara Lead Paint Litigation--Opposing Private Attorney General Actions

The court is being asked to decide whether it is appropriate for government entities to retain private counsel to prosecute public nuisance actions. NFIB argues that the government's retention of a private attorney under a contingent fee agreement is inappropriate and antithetical to the standard of neutrality required by attorneys representing the public.
