Passage of SB 7 Removes Economic Development as 'Public Use' Regarding Eminent Domain
The Delaware General Assembly passed and the governor has signed SB 7. The legislation, strongly supported by NFIB, requires state, county or municipal governments, or state agencies or other condemning entities, to use their eminent domain authority solely for “public use." The bill specifically states that the benefits derived from economic development do not constitute a public use.
