Small Business Committee marks up Regulatory Flexibility Act improvements

Washington, DC (May 11, 2016) – Today, the Senate Committee on Small Business and Entrepreneurship
approved legislation to strengthen the Regulatory Flexibility Act (RFA)
process. The Prove It Act of 2016 was introduced by Sen. Joni Ernst (R-IA). The
bill would require a third-party review when an agency and the Small Business
Administration’s Office of Advocacy disagree on a small business impact.
“Right now, agencies face almost no blowback when
they blatantly ignore the RFA,” said Amanda
Austin, NFIB Vice President of Public Policy. “We are grateful that committee
has approved Sen. Ernst’s legislation to give the law more teeth. The Small
Business Administration Office of Advocacy does a noble job of calling out
agencies, but right now they can simply be ignored with few immediate
consequences.”
NFIB has written a letter supporting the legislation.
