NFIB says today’s decision enables NLRB to rig union elections against employers

Washington, D.C. (June 10, 2016) – In a significant defeat for small business, the Fifth Circuit Court of Appeals today upheld a controversial union election rule that essentially tips the scale against small business owners.  NFIB Small Business Legal Center Executive Director Karen Harned issued the following statement in response: 

“Small businesses everywhere are extremely disappointed by the decision, which puts employers at a severe disadvantage,” said Harned. “The rule essentially makes it impossible for small businesses to respond to unionization campaigns. It also hurts employees by compromising their privacy, as the rule requires them to hand over sensitive information.”
