Stop the Labor Cabinet from Diverting Money from the Workers' Comp Special Fund

Sen. Chris McDaniel has filed a bill to curb the diversion of funds from the Workers’ Compensation Special Fund to the Labor Cabinet’s operating budget.  

Created in 1996, the fund was designed to retire previous workers’ comp claims made before the Patton administration’s overhaul of the workers’ comp system. However, there’s a provision in place that allows the Labor Cabinet to divert employer assessments from the special fund to cover the cabinet’s overhead.  

Over $100 million in employer funds has been transferred away from paying claims. Senate Bill 63 will stop the increase in the Labor “take”and focus on settling these claims and getting them off the books.
