Supreme Court Ruling in Workers’ Comp Case Devastating for Small Business

April 28, 2016, Tallahassee, FL – Statement by NFIB/Florida’s Executive
Director Bill Herrle in response to today’s ruling by the Florida Supreme Court
in the Castellanos v. Next Door Company case on workers’ compensation fees:

“The historical record is
clear. This opinion will allow workers’ compensation litigation to explode, and
that is unsustainable for the business community.  The court seeks
‘reasonableness’ regarding attorneys’ fees, yet they neglected to recognize
that ‘reasonableness’ is a two-way street.

“Without immediate legislative action, this decision will result in a devastating
rise in workers’ compensation insurance rates that will adversely affect our
economy, job growth and small businesses.”
