Wisconsin Looks to Ban the Bag Ban
Cities in Wisconsin may not pass bans against plastic bags after Gov. Walker signed Assembly Bill 730 in March.
While there weren’t any current restrictions on plastic bags in the Badger State, AB 730 aimed to preempt any local government attempts to introduce them. Legislators proposed the bill after seeing many municipalities around the country implement similar bans.
AB 730 gives the state authority over the regulation of “auxiliary containers,” such as bags, bottles, or other reusable or single-use packaging. In addition to preventing bans, AB 730 prohibits local governments from imposing a fee for the use of these containers or regulating their disposition or sale. The legislation, however, allows recycling programs to continue and does not prevent the Legislature from enacting a ban, imposing a tax or assessing a fee on such containers.
NFIB supported this legislation because it will maintain a level playing field across the state instead of allowing a confusing and costly patchwork of regulations to be implemented in different cities.
